I am pleased to inform of my appointment by the Minister of Culture and National Heritage of Poland as the arbitrator to the Copyright Commission for a five-year term.

The competences of the Commission include, inter alia:

1) approval of the copyright remuneration tables for the use of works or objects of neighboring rights; approved rates must be used in agreements between Collective Management Organisations (CMO) and the users of rights and no deviations from them are possible in the contract;

2) mediation (dispute resolution):

- regarding the application of the copyright remuneration tables,

- related to the conclusion and terms of the contract for cable retransmission,

- when, in the event of failure of bilateral negotiations between the user of the rights and the CMO, no final agreement was reached; it is worth noting here that the sanction for not using the Commission's mediation in such a case may result in an obligation to reimburse the court costs irrespective of the final outcome of the court proceeding.
